1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of blaze360.pro and any related services (collectively, the "Service"), operated by BLAZE 360 ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
We may update these Terms from time to time. If we make material changes, we will update the "Last Updated" date above and, where appropriate, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
2. Description of the Service
BLAZE 360 provides campground and outdoor recreation discovery tools, including but not limited to: campground and campsite information, 360° virtual tours, an Adventure Hub for outdoor activity discovery, weather and "Campability" scoring, trip planning tools, and links to third-party booking/reservation platforms.
The Service aggregates and displays information from a variety of public and third-party data sources. While we work to keep this information accurate and current, we do not guarantee the accuracy, completeness, or timeliness of any campground, trail, weather, availability, or booking information displayed on the Service. Conditions at outdoor recreation sites can change quickly and without notice (weather, closures, hazards, road conditions). Always verify critical information directly with the relevant land management agency or booking platform before travel.
3. Accounts
To access certain features (saving favorites, submitting ratings, subscribing to Premium), you may need to create an account. You agree to:
- Provide accurate and complete information when creating your account.
- Keep your login credentials secure and confidential.
- Notify us promptly of any unauthorized use of your account.
- Be responsible for all activity that occurs under your account.
You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
4. Premium Subscriptions
BLAZE 360 offers optional paid subscription tiers ("Premium"). By subscribing, you agree to:
- Pay the subscription fees in effect at the time of purchase (monthly or annual, as selected).
- Automatic renewal of your subscription at the end of each billing period, unless canceled before the renewal date.
- Our right to change subscription pricing with reasonable advance notice; continued use after a price change constitutes acceptance of the new price for future billing periods.
- Payment is processed by a third-party payment processor. We do not store your full payment card details on our own servers.
Refunds and cancellations: You may cancel at any time; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.
5. Third-Party Services and Booking Platforms
The Service integrates data and functionality from third-party providers to power features such as mapping, campground and trail information, weather forecasts, and outdoor activity data.
Booking disclaimer: When you check availability or choose to book a campsite, you will typically be directed to a third-party reservation platform to complete that transaction. BLAZE 360 does not process bookings or reservations directly and is not a party to any reservation you make. Your booking, payment, cancellation, and any disputes related to it are governed entirely by the terms of that third-party platform, not by BLAZE 360. We are not responsible for the accuracy of availability shown on our Service, for the third-party platform's handling of your transaction, or for any loss arising from your use of a linked third-party service.
We are not responsible for the content, accuracy, or practices of any third-party sites or services linked from the Service.
6. User Content
The Service may allow you to submit content, including but not limited to campsite ratings (e.g., shade/privacy ratings), saved favorites, and — in the future — user-submitted photos or 360° imagery documenting campsites ("User Content").
By submitting User Content, you:
- Represent that you own or have the right to share that content.
- Grant BLAZE 360 a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute that content on and in connection with the Service.
- Agree not to submit content that is false, misleading, infringing, offensive, or that violates any law or the rights of any third party.
We reserve the right to review, moderate, remove, or decline to publish any User Content at our sole discretion, including content submitted through any future user photo-documentation feature.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Scrape, harvest, or bulk-extract data from the Service without our prior written consent.
- Interfere with or disrupt the Service, its servers, or networks.
- Attempt to gain unauthorized access to any part of the Service, other accounts, or related systems.
- Misrepresent your identity or impersonate any person or entity.
- Upload or transmit viruses, malware, or other harmful code.
We reserve the right to suspend or terminate your access to the Service, with or without notice, for conduct that violates these Terms or is otherwise harmful to the Service, other users, or third parties.
8. Intellectual Property
The Service, including its design, text, graphics, logos, and underlying code, is owned by BLAZE 360 or its licensors and is protected by intellectual property laws. Except for User Content and third-party data displayed under license (e.g., public recreation data), you may not copy, modify, distribute, or create derivative works from the Service without our prior written permission.
Data sourced from public/government providers and open-data sources retains any attribution or licensing terms required by those sources, which we comply with separately from these Terms.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Outdoor recreation carries inherent risks, including but not limited to weather, terrain, wildlife, and remote/limited-connectivity locations. You assume full responsibility for your own safety and decisions when engaging in any activity, visiting any location, or relying on any information (including weather, "Campability" scores, trail difficulty, or cell coverage information) obtained through the Service. BLAZE 360 is not a substitute for official safety information, land management agency guidance, or your own judgment and preparation.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BLAZE 360 AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, or any loss of profits, data, or goodwill, arising from or related to your use of the Service, including but not limited to reliance on campground, weather, availability, or trail information, or any issue arising from a third-party booking platform.
In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless BLAZE 360 and its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.
12. Termination
We may suspend or terminate your account and access to the Service at any time, with or without cause or notice. You may stop using the Service and, if applicable, cancel your Premium subscription at any time in accordance with Section 4.
13. Governing Law
These Terms are governed by the laws of the State of Utah, without regard to its conflict of law principles.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
